Terms of Use

We are Gin and Ivory Pte. Ltd. (hereinafter referred to as “we”, “us”, “Gin and Ivory”), a company incorporated in Singapore.

 

1. Effect of Terms of Use

The Terms of Use stated on this page and other related documents apply to any services rendered to you while accessing and using our website www.ginandivory.com (hereinafter referred to as the “Site”).

You should read through the Terms of Use prior to using the Site as your use of the Site indicates that you acknowledge, understand and agree to be bound by the Terms of Use.

The Terms of Use may be updated as and when the need arises, with or without notice. As such, you should check this page regularly to note any changes which may have been made.

The Terms of Use shall prevail over any separate terms put forward by you, unless explicitly agreed in writing, authorised and signed by all directors of Gin and Ivory.

 

2. Your Use of the Site

Eligibility

You must be at least 18 years of age to use this Site. If you are under 18 years of age, you are required to obtain permission from your parents or guardian before using this Site.

Purpose of Purchase(s)

All purchases made from the Site must be for personal or gift use only and must not be used for any commercial purposes or to derive any commercial benefit.

Access to Site

At our absolute discretion and decision, the Site may be made unavailable to you, for use or access, at any time, for any period. We reserve the right to disable any user account at any time, withdraw or amend access to any individual or entities to some parts of or the entire Site.

Links to Site

You may not link to the Site in a manner that may harm or implicate our reputation or inaccurately suggest an association with us or endorsement by us.

Intellectual Property Rights

You must not download, distribute, modify, post, reproduce or howsoever deal with or use any content or material from the Site, unless explicitly agreed in writing, authorised and signed by the directors of Gin and Ivory.

Prohibitions

You undertake not to misuse the Site. We will take legal action against any conduct which unlawfully threatens or implicates us, including but not limited to the following:

  • Misrepresentation of identity or affiliation with any person or entity;
  • Attempts to gain unauthorized access and interference with the functioning or utilization of the Site;
  • Use or upload of any software or material which may steal or corrupt the Site's data or interfere with the operation of another customer’s device or use of the Site; and
  • Publications on or transmissions through the Site of any information or material that is offensive or damages our reputation.

 

3. Our Limits on Liability

Third Party Website

The Site may contain links to third party websites which are not affiliated, owned or monitored by us, including third party payment system providers. You acknowledge and agree that we are not responsible for any and all of their content, privacy policies and services offered; or for any other loss or damage that may arise from your access or use of them.

Warranties and Liability

You expressly agree that your access to and use of the Site is at your sole risk. The Site, its services and all information provided herein are without warranties of any kind, either expressed or implied, other than those imposed by law.

Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from:

  • The security of the Site;
  • Any and all errors or omissions in the content or materials on the Site, including inaccuracies with regards to reliability, accuracy, completeness, validity or typographical errors;
  • Wear and tear or life of any product;
  • The suitability of any product for any particular purpose or use under any specific conditions notwithstanding that such purposes or conditions may be made known to us;
  • Negligence and misuse of any product;
  • Any remedy or alteration of any product; and
  • Any loss of profit, or any indirect or consequential loss arising under or in connection with your use of the Site.

Force Majeure

We shall not be held responsible for failure to meet any of our obligations under the Terms of Use where such failure is due to events beyond our reasonable control. Such events include, but shall not be limited to natural disasters; war; terrorist attacks; riots; strikes; epidemics; impossibility of the use of public or private transport; impossibility of the use of public or private telecommunications networks; the acts, decrees, legislation, regulations or restrictions of any government.

If we are prevented from fully meeting our obligations due to any such events, we have the sole discretion which obligations we will perform and to what extent.

Indemnities

You agree to indemnify and hold harmless Gin and Ivory, its directors, employees, consultants, agents, affiliates and representatives from any and all third party claims, damages, liabilities, losses, and costs (including but not limited to legal fees) arising out of your use of this Site or your breach of the Terms of Use.

 

4. Privacy Policy

Your use of this Site signifies that you understand and agree to this Privacy Policy. This Privacy Policy applies to personal data collected, used and disclosed (including transferred out of Singapore) by Gin and Ivory.

Use of Personal Data

We collect your personal data to facilitate and enhance our online and offline services to you. This includes but is not limited to:

  • Creating customer accounts to facilitate your purchases;
  • Customising the content of the Site to best-suit your browsing habits on our Site, individual preferences and interests; and
  • Sending store updates and contacting you via email, post or telephone where appropriate.

Disclosure of Personal Data

We do not sell or trade your personal information to external parties.

However, to facilitate and enhance our online and offline services to you, we may disclose your personal data to the following individual and entities:

  • Gin and Ivory’s related corporations, business units, parents and subsidiaries; and
  • Necessary third-parties including but not limited to individuals and entities who assist in marketing and advertising, running the Site, delivering and shipping our parcels, payment service providers, warehouse staff and order packers.

We may also disclose your information in order to comply with any requirement of the law.

We may transfer your personal information as an asset in the event of a merger or acquisition or sale involving all or part of our business or as part of a corporate reorganization.

You will receive a notice from us in the event that we would like to disclose your personal data to any third party for any reason other than as set forth in this Privacy Policy.

Our Right to Amend the Privacy Policy

We reserve the right to amend and update our Privacy Policy at any time, with or without notice.

 

5. Product Accuracy

We try to be as accurate as reasonably possible in our descriptions of products available for purchase through the Site. However, we do not warrant that product descriptions or any other content on the Site are accurate, complete, current, error-free or reliable.

Variations in Colour

We strive to portray the most accurate colour of our products on the Site. However, colours may sometimes appear slightly different in reality due to studio lighting conditions, or variances in computer screen calibration.

Variations in Measurement

There may be minor variations in measurement. As each piece is individually made, please allow a variation of +/- 1 inch from what is stated in the product description. These products will not be classified as defective.

 

6. Payment and Shipping

All orders placed on the Site are irrevocable and unconditional. We reserve the right to accept or decline any and all orders received in our sole and absolute discretion.

If we are unable to process your order for any reason, we will inform you.

Payments

Accepted modes of payments are Paypal, American Express, MasterCard and VISA.

Domestic Shipping (Singapore)

All local orders are delivered free of charge via our courier service provider, NinjaVan. 

The estimated delivery time is 3-5 working days from date of dispatch. However, expect potential delays of up to 6-10 working days for peak periods. 

International Shipping

We ship internationally via DHL express and charge a flat fee of SGD 30.  This excludes associated customs and import duties or taxes, which vary from country to country and are to be borne by the customer.

Bounced Parcels

We will be in touch via email in the event of a bounced parcel. However, bounced parcels that are unclaimed after 3 months will be deemed as Gin and Ivory’s property and no compensation will be offered.

 

7. Returns

Conditions for Return

We allow one-time returns* for all orders within 14 days (for Singapore orders) and within 30 days (for international orders) from the date of invoice. To return an item, the following steps must be followed:

Step 1: To return an item to us, the item has to be unworn, unwashed, unaltered and must have its tags intact.
Please check and ensure that this is complied with before proceeding with Step 2. In the event that an item is returned to us in an unsuitable condition, we will send the item back to you and invoice you for related shipping costs.
Step 2: Fill in the returns form here. This must be done within the timeline stated above.
Step 3: Our team will get in touch with you within a week on the process of sending your item back to us.

Please note that all postal fees, custom duties and taxes for returns are to be borne by you.

In addition, we recommend sending your item back to us via a traceable mode of delivery as we will not be liable for any loss of parcel during its transit. We will not be able to process a refund should your parcel fail to reach us.

Store Credits

If the item is returned to us in a suitable condition, we will provide you with a full refund in store credits. We will endeavour to process your refund within a week from receipt of your item.

Please note that store credits must be used within six months from the date of issue.

*Items purchased in whole or in part with store credits may not be returned.

Defective or Incorrect Items

We apologise for any inconvenience caused. Kindly reach out to us at hello@ginandivory.com with a description and picture of the defect and we will be in touch as soon as we can.

 

8. General

Waiver

Any failure or delay by us in exercising any rights or remedies stated in the Terms of Use does not constitute a waiver of such rights or remedies.

A waiver is only effective if expressly stated to be a waiver, communicated to you in writing and authorised by all directors of Gin and Ivory. A waiver does not represent or determine a waiver of any subsequent default.

Severability

If any part of the Terms of Use is determined by any court of competent jurisdiction or competent authority to be invalid, unenforceable or unlawful, the enforceability of any other part of the Terms of Use will not be affected. All remaining terms, conditions and provisions will continue to remain valid, effective and enforceable to the fullest extent permitted by law.

Assignment

You may not assign, transfer, sub-contract or howsoever deal with the Terms of Use or any rights and obligations under the Terms of Use to any party.

You acknowledge and agree that Gin and Ivory may transfer its rights and obligations under the Terms of Use to another organisation.

Third Party Rights

A person who is not a party to the Terms of Use shall not acquire any rights under it or be entitled to benefit from any of its terms even if that person has relied on any such term.

Governing Law and Dispute Resolution

The Terms of Use and any dispute or claim arising out of or in connection with it shall be submitted to the exclusive jurisdiction of the Singapore Courts, and governed and construed in accordance with Singapore Law. 

In the event of any dispute or claim arising out of or relating to the Terms of Use, you acknowledge and agree that you shall not proceed to litigation or any other forms of dispute resolution unless you have made reasonable efforts to resolve the same with us through mediation in accordance with the mediation rules of the Singapore Mediation Centre.
